BitPet Terms of Service

1. THE CONTRACTUAL RELATIONSHIP
These Terms of Service (“Terms”) constitute a legally binding agreement between you and BitPet AS, Christian Krohgs gate 30, 0186 Oslo, Norway (“BitPet,” “we,” or “us”). These Terms, together with our Privacy Policy, constitute the entire agreement between the parties. Processing of personal data is governed by the Privacy Policy. To the extent permitted by law, you acknowledge that you have not relied on any statements or marketing promises outside of these Terms.
2. LIMITED LICENSE & INTELLECTUAL PROPERTY
2.1 Grant of License. Subject to your compliance, BitPet grants you a personal, non-transferable, non-sublicensable, and revocable license to use the Services for personal, non-commercial entertainment.
2.2 Accounts. Your account is a limited license to access the Services; you do not own your account. Accounts are personal and non-transferable. BitPet retains control over all accounts and may suspend or terminate them in accordance with these Terms and applicable law.
2.3 BitPet Ownership. BitPet exclusively owns all rights in the Services, including pet designs, DNA algorithms, and trademarks.
2.4 Assignment. BitPet may freely assign its rights and obligations under these Terms to any third party. You may not assign or transfer your account, or any rights under these Terms, without our express prior written consent.
3. ELIGIBILITY & 2026 AGE ASSURANCE
You must meet the minimum age (13, or 16 in certain EEA countries) to create an account. We utilize platform-level "Age Signals" for verification. Parents are legally and financially responsible for all actions and purchases made by minors on their accounts.
4. SAFE USE & AR-SPECIFIC RISKS
4.1 Awareness. BitPet is an Augmented Reality (AR) game. You MUST remain aware of your surroundings at all times. Do not play while driving or operating machinery.
4.2 Trespass. Entering private property or hazardous zones is strictly prohibited.
4.3 Real-World Mapping. Location data and AR object placement may be inaccurate. We are not responsible for mapping errors or if AR objects appear in unsafe conditions.
4.4 Liability Limitation. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BITPET SHALL NOT BE LIABLE FOR PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH RESULTING FROM YOUR USE OF THE SERVICES, SAVE FOR CASES OF GROSS NEGLIGENCE OR WILLFUL MISCONDUCT BY BITPET.
5. USER-GENERATED CONTENT (UGC)
5.1 License & AI Training. You grant BitPet a perpetual, irrevocable, worldwide, royalty-free, and fully sublicensable license to use, reproduce, modify, and distribute your UGC (e.g., AR photos) for any purpose, including for training and improving our AI systems, and to sublicense these rights to third parties. To the extent permitted by applicable law, you waive all moral rights in your UGC.
5.2 Rights & Consents. You represent and warrant that you have all necessary rights, consents, and permissions to submit UGC, specifically regarding individuals appearing in photos or copyrighted environments.
5.3 Retention. BitPet has no obligation to store, maintain, or provide copies of UGC. We may remove content at any time. Appeals regarding removed content can be made via legal@bitpet.io pursuant to the EU Digital Services Act.
6. ANTI-CHEATING & ACCOUNT TERMINATION
6.1 Integrity Monitoring. We use telemetry limited to gameplay integrity to detect GPS spoofing or modified software. Our determination of violations is final, subject to applicable law. BitPet is not liable for good-faith enforcement actions taken to protect the Services.
6.2 Termination. We may suspend or terminate your account with or without notice (except where notice is required by law) for fraud suspicion, legal risk, or platform violations. You have the right to appeal via legal@bitpet.io. Upon final termination, all progress and virtual items are forfeited.
7. VIRTUAL CURRENCY & EEA CONSUMER RIGHTS
7.1 Nature of Items. Virtual items are digital licenses with no cash value. They are not transferable outside the Service and are not redeemable for money or monetary value.
7.2 EEA Withdrawal Right. If you are in the EEA, you have a 14-day statutory right to withdraw from a purchase. However, by clicking "Purchase," you expressly consent to immediate performance and acknowledge you lose your right of withdrawal once the content is delivered.
7.3 Refunds & Taxes. Refunds may be subject to the policies of Apple or Google. Prices may include applicable taxes as determined by the platform provider.
8. SERVICE MODIFICATIONS & AVAILABILITY
8.1 Modifications. We may modify or discontinue features with reasonable notice where feasible. We are not liable for loss of data, progress, or content.
8.2 Performance & Availability. We provide no guarantee that the Services will be continuous, error-free, or available at any given time. We do not guarantee device compatibility across all hardware or networks.
8.3 Dependencies. Services depend on third-party providers (GPS, Apple, Google). We are not liable for outages caused by these parties.
9. INDEMNIFICATION
To the extent permitted by applicable law, you agree to defend and indemnify BitPet AS from any claims, damages, or legal fees arising from your UGC, your breach of these Terms, or your physical actions while playing.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BITPET AS IS NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING LOSS OF DATA. OUR TOTAL LIABILITY IS CAPPED AT THE AMOUNT YOU PAID US IN THE PRECEDING SIX MONTHS OR €100, WHICHEVER IS GREATER. Nothing in these Terms limits liability for: (a) death or personal injury caused by our negligence; (b) fraud; or (c) mandatory consumer rights that cannot be waived.
11. FORCE MAJEURE
BitPet is not liable for failures caused by events outside our reasonable control, including failures of cloud infrastructure providers, strikes, war, or changes in government regulation.
12. EXPORT CONTROL & SANCTIONS
You represent that you are not: (a) located in a country subject to an embargo by Norway, the U.S., the EU, or other applicable jurisdictions; or (b) listed on any government list of restricted parties. You agree not to use the Services in violation of applicable export control laws.
13. DISPUTE RESOLUTION & GOVERNING LAW
13.1 Governing Law. These Terms are governed by Norwegian Law. The English version governs in case of translation conflicts.
13.2 U.S. Residents. To the extent permitted by applicable law, you agree to binding, individual arbitration and waive your right to a jury trial or class action.
13.3 Venue. Non-arbitrated claims shall be brought exclusively in the Oslo District Court (Oslo tingrett). Nothing in these Terms overrides mandatory local consumer jurisdiction rights where required by law.
14. SURVIVAL & PRIORITY
14.1 Survival. Sections regarding Intellectual Property, Account Rules, UGC Licenses, Export Control, Liability, Indemnity, and Dispute Resolution shall survive any termination of these Terms.
14.2 App Store Priority. If distributed via Apple or Google, their terms may apply. In case of conflict, platform terms take precedence where required.
